CAMBRIDGE, MA - April 12, 2004 -
EchoMail, Inc., provider of E-Mail Relationship Management solutions and one of the early advocates of E-Mail Privacy Best Practices, issued an advisory today that the FTC has extended to April 20, 2004 the period for public comment regarding the CAN-SPAM Act.
At the heart of the CAN-SPAM discussion is-what is Unsolicited Commercial Email? When the Act took effect January 1, this year - it set forth a list of mandates including that the FTC further define commercial e-mail. As a result, the FTC is seeking public comment on the mandatory ''primary purpose' rulemaking, defining commercial e-mail, as well as comment on other areas of discretionary rulemaking established in the Act.
Described in detail in the Federal Registry, areas include: The Act's definition of ''transactional or relationship messages;'' the Act's enumeration of ''aggravated violations;'' and the implementation of the provisions of the CAN-SPAM Act generally.
Some specific questions posed by the FTC include: 1) how to determine whether an e-mail's primary purpose is commercial; 2) if 10 days is an appropriate period to process an opt-out request; 3) if "forward to a friend" campaigns fall under CAN-SPAM; and 4) if it would be useful to further clarify what constitutes a "valid physical postal address." The latter is only required for commercial mailings.
Formatted in an easy-to-use webform, the FTC Comment Form takes about 10 minutes to complete and provides an option of including your own comments. All information submitted, becomes public record, although the FTC does make every effort to remove from public view home contact information.
