California’s Online Privacy Protection Act Becomes Effective July 1, 2004.
All 50 states affected by new California law for consumer privacy.


CAMBRIDGE, MA – June 22, 2004 - EchoMail, Inc., provider of E-Mail Relationship Management solutions has issued an Advisory for businesses engaged in online transactions with California residents, as the California’s Online Privacy Protection Act of 2003 becomes effective July 1, 2004.

The new California law requires businesses, web operators from all 50 States that collect personally identifiable information from California residents via the web, to clearly post the company’s privacy policy on their website.

In drafting this legislation, California amends existing law to include online transactions, to ensure the security and confidentiality of consumer personal and identifying information obtained by persons and entities through online business.

California identified several key areas to improve consumer protection online, and the Online Privacy Protection Act requires that all companies engaged with California residents via the web, update their privacy policy to meet those provisions.

Website visitors must be able to easily find the privacy policy, have access to additional information; particularly what categories of personally identifiable information is collected, type of third-party sharing (if any), and visitors must be able to review their submitted information and request changes. Companies are responsible for making sure that in addition to disclosing to the consumer what data they gather, that the privacy policy effective date is clear and the process by which visitors are notified of changes in their privacy policy is also clearly identified.
